The move follows a jury ruling last year thatthe plant’sd previous owner, Cinergy Corp., violated federal emissionds standards after it refurbished the units withoutg a permit. Charlotte-based Duke bought Cinergy in Aprilp 2006for $9 At the time of last year’x ruling, Duke proposed that units 2, 3 and 5 be retirexd in 2012, when the company’sz new integrated gasification combined-cycle plant in Edwardsport, Ind., comes on line. The court’sd order accelerates that timetablse bythree years. Shutting down units 2, 3 and 5 will removew a combined capacity of265 megawatts. That is 39 percenr of the station’s 677-megawatt power-generatinb capacity.
The units affected by the judge’ s decision are more than 50 years old, says Jim Turner, presiden t and chief operating officerof Duke’s franchised electric and gas He says the order should not impact the company’x operations this year becausde of changes Duke had already made following the jury’w verdict last year.
